    Der EuGH hat entschieden, dass eine nationale Verwertungsgesellschaft keine erheblich höheren Tarife anwenden darf, als sie in den übrigen Mitgliedstaaten üblich sind, da dies für den Missbrauch einer marktbeherrschenden Stellung spreche. Gleichzeitig hat der europäische Gerichtshof entschieden, dass nationale Verwertungsgesellschaften, denen durch nationales Recht ein Gebietsmonopol eingeräumt werde, bis auf weiteres zulässig seien.
